Customer Agreement

DEFINITIONS

Throughout this Agreement where the context so requires, the singular includes the plural and vice versa and the masculine the feminine and the following expressions have the following meanings:
  1. Account – Any account(s) of the Cardholder that can be accessed using the Card.
  2. Alert Service – An optional service that authorizes the Bank to send an email or SMS notification to the Cardholder for specific events, notices or Transactions
  3. ATM – Automated Teller Machine
  4. Authorised User– a joint Cardholder to whom an additional Debit Card has been issued.
  5. Bank – Citizens Bank Guyana Inc.and its successors and assigns
  6. Business Day – The time between successive ATM settlement processes.
  7. Card – The Citizens Bank Guyana Inc. Visa International Debit Card issued to customers
  8. Cardholder – The customer to whom or for whose use a Card is issued by The Bank and includes an authorised user.
  9. Daily Limit Designated– Maximum amount that can be debited by use of Card for a specific category of Transactions.
  10. Designated Bank Accounts– Those accounts that can be accessed through an ATM or Point-of-Sale Device or other means as may be defined by The Bank from time to time.
  11. Foreign transaction– Any transaction that you complete, or a merchant completes on your card outside of the jurisdiction of the Republic of Guyana.
  12. Issuing Branch-The Bank from which the Cardholder obtained his card.
  13. Merchant– The corporation, firm or individual who has agreed to honour The Card upon presentation.
  14. PIN – The Personal Identification Number, used as an electronic signature, which is needed to access the designated account through an ATM or other means as may be defined by The Bank from time to time.
  15. Point-of-Sale Devicean electronic device used by merchants/retailers to transmit requests for authorization and settlement of transactions made by a Cardholder at a retail establishment and evidenced by a PIN.
  16. Transaction – Any use of a Card to access funds, make deposits or inquire into a Designated Account.
  17. You or Your– The Cardholder or an authorised user.

CONDITIONS OF USE

  1. USE OF THE CARD
    The Cardholder must maintain physical possession of the Card at all times. The card must be signed by Cardholder immediately on receipt and may only be used:
    1. by the Cardholder
    2. subject to the Conditions of Use current at the time of the Transaction.
    3. to obtain the facilities and benefits from time to time made available by the Bank in respect of the use of the Card.
    4. for Transactions subject to any limit set by the Bank and/or VISA.
    5. during the validity period embossed on the Card.
    6. to access available funds in the associated account(s).
    7. at VISA branded locations or proprietary Citizens Bank machines.
    8. subject to the right of the Bank in its absolute discretion and without prior notice, at any time to withdraw the right to use the Card for, or to refuse any request for authorization of, any particular Card Transaction and to publish any such withdrawal or refusal.

    You may not use the Card for any illegal or unlawful transaction and agree to hold the Bank harmless and indemnify it if you do.

  2. ALERTS
    1. The Bank will send an Alert to the Cardholder on the Completion of all Transactions flagged for the service.
    2. The Bank reserves the right to charge fees in connection with these notifications
    3. The Cardholder undertakes to immediately notify the Bank of any change of email address or mobile number identified for the use of the Alert Service.
    4. The Bank shall not be liable if the Alert is received by someone other than the Cardholder.
    5. The Bank shall not be liable if it is unable to send Alerts due directly or indirectly to the failure of any machine, data processing system or transmission link, industrial dispute or anything out of the control of the Bank.
  3. CHARGES
    1. The Cardholder shall be liable for any loss or cost which the Bank determines it has suffered as a result of any breach of the Conditions of Use of the Card
    2. The Bank reserves the right to charge fees in connection with transactions.
    3. The Bank shall be at liberty to vary all fees and charges imposed pursuant to the use of the Card and to include such other charge as it may consider necessary from time to time and the Cardholder irrevocably authorizes the Bank to debit his/her account with all such charges and expenses.
  4. TERMINATION
    1. The Bank may at any time and without notice cancel or suspend the right to use the Card entirely or in respect of specific facilities or refuse to re-issue, renew or replace any Card, without in any case affecting the Cardholder’s obligations which shall continue in force.
    2. The Card remains the property of the Bank at all times. On request all or any Cards issued for use on the Account must be returned immediately to the Bank or to any other person acting for the Bank
    3. The Cardholder may cancel the Card by notice to the Bank. This notice should be submitted to the Bank in writing or sent through Secured Message in our Internet Banking Service.
  5. SECURITY OF THE CARD
    1. The Cardholder must retain possession of the Card at all times.
    2. The Cardholder will exercise all possible care to prevent the PIN from becoming known to any person
    3. In the event the Card is lost or stolen the Cardholder must immediately notify the Bank. This notification can be made in person or in writing and will be effected by the next business day. Immediate Card deactivation is available for Internet Banking customers through our website.
    4. The Cardholder will give the Bank all information in the Cardholder’s possession as to the circumstances of the loss, theft or misuse or the disclosure being suspected, the Bank may provide the police with any information it considers relevant.
    5. If a Card is reported as lost, stolen or liable for misuse, that Card must not be subsequently used. If the Cardholder regains possession of the Card, it must be immediately destroyed.
    6. Until the Bank receives notification, the Cardholder will be liable in respect of any use of the Card.
  6. TRANSACTIONS
    1. The Cardholder may use his/her Card to access his/her Designated Account(s) to obtain cash, make deposits, or to transfer money between Designated Accounts, pay for goods and services or to utilize any other services available. Other transactions may be offered and permitted in the future
    2. In case of joint Designated Accounts any one of the Designated Account holders is empowered to deal with the account. The signature on this document of any one of the holders makes all account holders jointly and severally liable for transactions effected by one account holder regardless of whether they are Cardholders or not.
    3. The Bank’s records as to whether use has been made of the Card shall be conclusively deemed to be correct and shall be binding upon the Cardholder
    4. The Cardholder shall be permitted to make payments / cash withdrawals during a business day up to the Daily Limit as set by the Bank.
    5. All deposits made by the Cardholder through the ATM are subject to verification by the Bank. The Cardholder agrees that such verification shall be binding and conclusive evidence of the actual amount involved in any such Transaction.
    6. Deposits are processed to the accounts AFTER the ATM has been cleared and the deposit verified
  7. The Bank reserves the right to vary this CONDITIONS OF USE document from time to time. The MoneyCard CONDITIONS OF USE document with all updates may be viewed at: www.citizensbankgy.com
  8. General
    1. In the event of conflict between this Conditions of Use and the agreement governing the operation of the Designated Account(s) that Agreement takes precedence.
    2. Any issue not covered under this document shall be resolved using the Terms and Conditions of the associated Designated Account.
    3. Any other facilities or benefits made available to Cardholders as such and not forming part of this document may be withdrawn at any time without notice.
    4. All terms and conditions apply.
    5. In the event that any clause herein or any portion thereof is held by a court to be invalid or unenforceable for any reason, the other clauses and portions of this document shall continue in full force and effect
    6. These CONDITIONS OF USE are governed by the Laws of Guyana and shall be subject to the jurisdiction of the Courts of Guyana.

DEBIT CARD AGREEMENT

THE USE OF THE CITIZENS BANK GUYANA INC. INTERNATIONAL DEBIT CARD IS GOVERNED AT ALL TIMES BY THE TERMS AND CONDITIONS SET FORTH:

  1. USE OF THE CARD
    1. The Card must be signed by the Cardholder immediately upon receipt and may only be used:
      1. By the Cardholder after it has been signed;
      2. For transactions subject to any limit set by the Bank and/or Visa, hereunder specified or subsequently set.
      3. Within the available balance of the Cardholder’s designated accounts at The Bank.
      4. At any ATM operated by the Bank, at the ATM of any other participating Financial Institution in the Visa and Plus network, and at the Points of Sale where Merchants are authorized to accept the Card and have the requisite facilities to accept the Card, and for online/internet purchases transactions
      5. Only for lawful purchases and transactions and subject to your agreement to hold the Bank harmless and indemnify it if you do otherwise.
      6. Until the Valid Thru date shown on the front of your Debit Card, except where the Debit Card is cancelled in accordance with this Agreement. When your Debit Card expires a debit card will be re-issued to you.
      7. Subject to the terms of this agreement and the conditions of use of the Card hereinafter specified and/or are current at the time of use, including the Bank’s right, in its absolute and sole discretion and without prior notice, at any time to cancel, refuse to re-issue, renew or replace the Debit Card or to withdraw the right to use the Debit Card for, or to refuse any request for authorization of any particular Debit Card Transaction and to publish any such withdrawal or refusal.
    2. PERSONAL IDENTIFICATION NUMBER (PIN)
      1. You agree to keep your PIN confidential and separate from your Debit Card at all times. Select a PIN which cannot be easily guessed. A PIN combination selected from your name, date of birth, telephone numbers or address can be easily guessed and must not be used.
      2. No one, but you, is permitted to know or use your PIN. If someone obtains your Debit Card and your PIN enabling them to be used together, you may be liable for their use of your Debit Card, more fully described at clauses 4 and 5 below.
    3. The Bank can at any time and without prior notice, cancel or suspend the right to use the Card temporarily or entirely, or in respect to certain facilities or refuse to reissue, renew or replace the Card without in any case affecting the Cardholder’s obligation to The Bank which shall continue in force.
    4. The Card is not a credit card, and its issuance does not permit the Cardholder to overdraw his account or to otherwise obtain credit from the Bank except where the Card is used to access funds on a credit facility previously approved by the Bank from a Designated Bank Account. The Card shall remain the property of the Bank at all times and shall be returned to the Bank by the Cardholder on demand.
    5. The Cardholder may use the Card and PIN in order to access an ATM. With the use of the Card and PIN, the Cardholder may obtain cash at any Citizens Bank Guyana Inc. ATM, or make deposits, bill payments and transfer money between Designated Bank Accounts. The customer may also obtain cash at any other ATM bearing the VISA logo.
    6. The Cardholder may use the Card in order to make payment for goods and or services at a participating point of sale, where a Merchant has the Merchant facility, and is authorized to accept the Visa Card.
    7. The Cardholder may use the Card and/or PIN to utilize any other services that may be accessible through the ATM, Point of Sale, or other such device as may be introduced by the Bank. New services may be introduced from time to time. The Bank will notify the Cardholder of the existence of these new services and the devices through which they may be accessed. By using these services when they become available, the Cardholder agrees to be bound by the rules herein so far as they are applicable to the new services and to any additional rules.
    8. All deposits made by the Cardholder through a Citizens Bank Guyana Inc. ATM are subject to verification by two of the Bank’s officers, whose verification the Cardholder agrees shall be binding and conclusive evidence of the actual amount involved in any such transaction.
      1. It is understood and agreed that all deposits made at a Citizens Bank Guyana Inc. ATM after normal banking hours shall be deemed to have been made on the next business day following that on which the said deposit was made.
    9. The Cardholder shall retain receipts for each transaction made at an ATM or Point of Sale Device with the Card. These receipts should be retained for reconciling the transactions. In cases of errors or questions about any transaction, the Cardholder shall contact the Bank as soon as possible provided that in respect of disputed transfers or payments from a Cardholder’s account, the Cardholder must submit written notification thereof to the Bank within fourteen (14) calendar days from the initiation of the relative transaction.
    10. If the Cardholder fails to effect written notification within the said period, the Bank shall not be held liable for any loss arising from the disputed transaction nor shall the Bank be liable to reverse or refund the effect of any such transaction including interest and transaction fees accruing or charged thereon. In extenuating circumstances, the Bank may in its absolute discretion extend the said Fourteen (14) day period.
    11. RESTRICTIONS/LIMITATIONS ON TRANSACTIONS
      1. Minimum operating balances remain in effect for all accounts, and International Debit Card transactions will be declined if they contradict the rules governing the account. The Bank reserves the right to decline any transaction where both the relevant fees or designated minimum balances and the sum being withdrawn cannot be accommodated at the time the transaction is executed.
      2. The Cardholder shall not withdraw any cash or make any debit transfer or payment against funds uncleared by the Bank, whether by use of the Card or any other means.
      3. The Cardholder understands that the use of the Card at other bank’s ATMs is restricted to cash withdrawals only. This restriction on limits will be specified by the Bank. The ATM or Merchant may in some circumstances retain the Card and not return it to the Cardholder. The Cardholder acknowledges that such restrictions and programmes are provided for the protection of the Cardholder, the Merchant and/or the Bank against wrongful use of the Card.
  2. ALERTS
    1. The Bank will send an Alert to the Cardholder on the Completion of all Transactions flagged for the service.
    2. The Bank reserves the right to charge fees in connection with these notifications.
    3. The Cardholder undertakes to immediately notify the Bank of any change of email address or mobile number identified for the use of the Alert Service.
    4. The Bank shall not be liable if the Alert is received by someone other than the Cardholder.
    5. The Bank shall not be liable if it is unable to send Alerts due directly or indirectly to the failure of any machine, data processings system or transmission link, industrial dispute or anything out of the control of the Bank.
  3. SECURITY OF THE CARD/LOST/STOLEN/MISUSED DEBIT CARD
    1. The Cardholder must retain possession of the Card at all times and shall use all reasonable precaution to prevent the loss, theft or destruction of the Card and will prevent the PIN from becoming known to any person other than the authorized Card user.
    2. If the Credit Card is lost, stolen or for any reason liable to misuse or if the PIN is disclosed in breach of the terms of this Agreement, the Cardholder undertakes to verbally notify the Bank immediately of such loss, theft or destruction and the circumstances thereof and further to confirm in writing such loss, theft or destruction and the circumstances surrounding same within 24 hours of any such occurrence.
    3. Failure to comply can result in loss of your money and loss of card privileges. The Cardholder shall in addition be liable for any and all use of the Card and the transactions created thereby until the Bank has received written notification of the loss or theft of the Card.
    4. Immediate Card deactivation is available for Internet Banking customers through our website
    5. Customer Service Support is available at any one of the numbers printed on the back of the Card. During Office Hours (07:45 to 16:45 Monday through Friday), the Bank may be contacted directly at (592) 226-1705 or (592)-226-1729. Contact can also be done by e-mail cardservices@citizensbankgy.com
    6. The Cardholder will give the Bank all information in the Cardholder’s possession as to the circumstances of the loss, theft or misuse or the disclosure being suspected, the Bank may provide the police with any information it considers relevant.
    7. If the Cardholder regains possession of the Card, it must be immediately destroyed.
  4. LIABILITIES
    1. In cases of joint accounts where any one of the account holders is empowered to deal with the Designated Accounts, all the account holders will be jointly and severally liable for transactions effected by one account holder regardless of whether they are Cardholders or not.
    2. Problems with merchants/limitation on liabilities of the Bank
      1. The Bank is not responsible for problems you have with anything you buy using your Debit Card at any ATM or online or any problems you have with the Biller when you use your Debit Card to pay a bill.
      2. You must settle any such problem directly with the merchant or Biller.
      3. When you make bill payments at one of our ATMs, you are responsible for ensuring that all Biller information (including account numbers and payer names) required by the Bank to complete your payment instructions to that Biller is accurate at all times.
      4. While the Bank tries to ensure that transactions are completed whenever you use your Debit Card for a purpose we have agreed to, we will not be liable to you for damages (including special, indirect or consequential damages) if an ATM or a merchant does not accept your Debit Card or you cannot use your Debit Card for any reason, including where we cancel or temporarily deactivate your Debit Card or decline to authorise a transaction because we have detected activity in your Account or the use of the Debit Card that we consider to be unusual.
      5. The Bank is not responsible for a Biller’s or merchant’s posting practices or if they charge you late fees or interest penalties.
      6. Any and all disputes between a Cardholder and a Merchant in respect of any Debit Card Transaction shall be resolved by and between the Cardholder and the Merchant, regardless of the nature of the transaction, whether local, foreign or online.
      7. In the case of such disputes, the Bank shall remain fully indemnified by the Cardholder in respect of any and all claims arising therefrom whether by the Merchant or any third party
    3. The Bank shall not be liable to the Cardholder for the operational failure of any participating ATM, Point-of-Sale Device or other such device as may be introduced by the Bank or for any injury, loss or damage howsoever arising whether from criminal activity or otherwise suffered by the Cardholder in the use of the ATMs, Point-of-Sale Devices or other such device as may be introduced by the Bank on or near premises housing the same.
    4. The Bank shall also not be liable for any unauthorized use of the Card or for any loss resulting from circumstances over which the Bank has no direct control including but not limited to the Cardholder’s failure to input complete and accurate information, failure of electronic or mechanical equipment or communication lines, telephone or other interconnectivity problem, operator error, log in sequences, severe weather, earthquakes, flood or other acts of God.
    5. In no event shall the Bank be liable for damages in excess of a Cardholder’s actual loss due to his failure to complete a transaction and the Bank shall not be liable for any indirect, incidental or consequential loss or damages.
    6. The Cardholder accepts the risks and consequences of part payments or late payments, and the Bank shall not be liable for any loss arising from these situations.
  5. CHARGES/FEES
    1. The Cardholder shall be liable for any loss or cost which the Bank determines it has suffered as a result of any breach of the Conditions of Use of the Card.
    2. The Bank reserves the right to charge fees in connection with transactions.
    3. The Bank shall be at liberty to vary all fees and charges imposed pursuant to the use of the Card and to include such other charge as it may consider necessary from time to time and the Cardholder irrevocably authorizes the Bank to debit his/her account with all such charges and expenses
    4. The Bank shall charge fees in respect of each transaction approved or declined, transacted at the ATM of any other participating financial institution in the Visa and Plus network or at Points of Sale where Merchants are authorized to accept the Visa Card, or other such device as may be introduced by the Bank; a schedule of such fees shall be available to the Cardholder.
    5. The Bank shall be at liberty to vary all charges imposed pursuant to this Agreement and to include such other charges as it may consider necessary from time to time and the Cardholder irrevocably authorizes the Bank to debit his / her account with all such charges and expenses. The bank may notify the Cardholder of such charges through their last known mailing address or other means as provided for in Clause 7 below.
    6. The Cardholder shall be aware that other financial institutions may from time to time impose charges in respect of each transaction, not relating to The Bank’s fees.
    7. FOREIGN TRANSACTIONS
      1. Transactions initiated in foreign countries and foreign currencies will be charged to your Account in Guyana dollars.
      2. The exchange rate between the transaction currency and the billing currency used for processing international transactions is a rate selected by Visa from a range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate Visa itself receives on the applicable central processing date.
  6. NOTICES
    1. Notices, including but not limited to those referred to herein, can be given by the Bank electronically via email, phone or through the post, and received from you to the Bank electronically via email, through the post or in person and verbally.
    2. The Cardholder will immediately notify the Bank in writing of any address changes and all notices mailed to the Cardholder’s last known address will be effective as though received.
    3. The Cardholder may cancel this service upon giving the Bank ten (10) days’ written notice of such intended cancellation and such notice shall, to be effective, be accompanied by the Card, cut in half
    4. The Bank may amend these conditions at any time in its absolute discretion. The revised Agreement and/or terms and conditions shall be effective on the date specified by the Bank. Any Notice of revisions shall be sufficient if sent to the Cardholder’s last known address, or if the Bank notifies the Cardholder electronically that revisions have been made and gives him/her instructions on how to obtain a copy of such revised Agreement and/or Terms and Conditions. The Cardholder’s continued use of the Card after the effective date of such revision will constitute his acceptance of the revisions and the revised Agreement.
    5. The Cardholder will be deemed to have received any Notice sent by mail six (6) days after posting, or if sent by e-mail, the day after it was sent.
  7. CLAIMS/WARRANTIES
    1. The Bank makes no claims or warranties with respect to the associated equipment or system and shall not be liable if it is unable to perform its obligations due directly or indirectly to the failure of any machine, data processing system or transmission link or to industrial dispute or to any cause outside the control of Citizens Bank, its Agents, Servants or Sub-contractors.
  8. DISCLOSURE
    The Bank will disclose information to third parties about the Cardholder’s Account in the following circumstances:
    1. In order to verify the existence and condition of the account for a Merchant;
    2. In order to comply with Court Orders or lawful government requests pursuant to Section 63 of the Financial Institutions Act, Cap. 85:03 of the Laws of Guyana; or
    3. The Cardholder gives the Bank written permission.
  9. TERMINATION
    1. The Bank may at any time and without notice cancel or suspend the right to use the Card entirely or in respect of specific facilities or refuse to re-issue, renew or replace any Card, without in any case affecting the Cardholder’s obligations which shall continue in force.
    2. The Card remains the property of the Bank at all times. On request all or any Cards issued for use on the Account must be returned immediately to the Bank or to any other person acting for the Bank.
    3. The Cardholder may cancel the Card by notice to the Bank. This notice should be submitted to the Bank in writing or sent through Secured Message in our Internet Banking Service.
  10. If any part of this agreement is found to be invalid, the rest remains effective.
  11. The obligations of the parties hereunder shall be governed by the Laws of Guyana.
